Purchase Terms & Conditions:
- The purchase price plus packaging, postage and insurance (if required by the purchaser) must be deposited into the artist’s bank account in South Africa prior to the painting being dispatched.
- If the purchaser chooses not to insure the painting, the artist and/or his estate will not be held responsible for any loss or damages.
- A quotation for packaging, postage and insurance will be provided to the purchaser for approval prior to any dispatching of paintings.
- Copyright of the artist’s works will remain with the artist and/or his estate unless this is ceded to the purchaser in writing prior to dispatching.
- The artist’s works may not be copied or reproduced in any manner whatsoever unless permission has been granted in writing by the artist and/or his estate.
- Infringement of the above terms and conditions shall result in legal action being instituted against the perpetrator for damages, penalties and recovery of all legal costs.
- A condition of the sale also requires that the domicile of the agreement be at Port Elizabeth South Africa.
- The artist / his estate will have the rights to all his works which will include, but not be limited to:
a. Reproductions of all forms and applications.
b. Royalties on reproductions.
c. Displays at shows, events or galleries.
Commissioning Terms & Conditions:
- If the artist is commissioned to produce a painting, a 50% deposit will be required upfront with balance payable on completion.
- On acceptance of a quotation to produce the painting, the artist will provide a rough sketch of the proposed work for approval.
- On acceptance of the sketch, the artist will proceed with the final work and will submit a low resolution colour image proof for approval.
